H1B REF notice OPT expires (Gap > 60 days)
Hi everyone,
I applied for H1B for FY 2008 quota. I recently received a 'REF
notice' from Vermont Service Center.
It says:
"According to the record, your OPT expires on July 04, 2007 and your
requested H1B start date is October 1, 2007. The gap between this
status change exceeds the 60 day grace period allowed for students.
Submit evidence establishing that you are or will be in valid
nonimmigrant status for the time period in question.
If you are unable to meet this requirement, your petition will be
forwarded to a consulate of your choice for consular processing."
If I enroll in a program (3 courses) that gives me an I-20, would it
count as an evidence?
I did my master's in software engineering. Does the program have to be
relevant?
As my OPT expires on July 4th, will I need to enroll for Fall or
Summer semester?
Can someone please suggest the programs I can apply for? Does anyone
know any school near Dallas that is not very expensive and can issue
an I-20?

A valid I-20 can be a document that u might need to provide in order
to produce and evidence to legal status while ur H1B is being
processed. COnsult with your lawyer on that.
One thing the remember is that as soon as ur I-20 is issued ur OPT
will be invalid (u wont be able to work under OPT as of the I-20 issue
date). The field of study can be unrelated.
BTW, just one question for u. Was ur H1B application premium
processed? (mine is undergrad quota and my company didnt agree to do
premium processing and i havent heard anything from the lawyer yet)..

Yes. Mine was premium processing. Btw, OPT will end at I-20 issue date
or when the classes begin?

Yes. Mine was premium processing. Btw, OPT will end at I-20 issue date
or when the classes begin?
