hi all,
i've really urgent question.
i've got my h1b visa until this february. i travelled outside the country
last year but since my passport was expiring they gave me only that passport
expiration date on my new I-94 which states pp expires. i went to local INS
office and told me i don't need to renew before month that i-94 expires with
my new passport.
now came to a situation where i need to file petition for renewal and my
lawyer believes that's not legal. i've to obtain new I-94 that time. can i
still file for it with my old I-94 or what should i do in this situation.
thanks

Aarrrrgghh.... It sounds like you fell into the trap of believing what a
USCIS officer told you. Unfortunately, the I-94 expires on the day written
on the I-94. That does not change automatically when you get a new
passport. The correct answer would have been to either leave the USA and
return, showing both passports, or to apply for an extension of your H-1B
status.
It seems like your lawyer understands the situation, so you may want to
follow his guidance.
