Hi

My wife is going to apply for H1 visa, in a few months, to get in to
US. I am green card holder, can i apply I-130 for her in the same
time? in case her H1b will be rejected, we can contiue I-130. I know I
cannot apply for student or visitor visa in the sametime for I-130.

Your wife can *not* apply for an H1-B visa... the company that is sponsoring her applies on her behalf. At any rate, unless her sponsor is a university, all the H1-B visas for this year have already been used. Her sponsoring company would need to submit an application in April 2008 for employment beginning in October 2008.


Yes, you can apply at the same time. Realize though, that it will be several years before a visa number becomes available to her. If you naturalize, your application for her can be upgraded and a visa made immediately available.
