Default H1B and H4 Renewal

Hi, My H1B and my wife's H4 visas expire in mid April. We have already applied for
renewal of both. My question is, while the INS processes our application will we be
out of status after our current visas expire in April?

No, you won't be. Your H-1B will be automatically extended by up to 240 days (or the
day INS decides your case, whichever comes first). I've been there, done that myself
a few years ago.

Your wife's H-4 will similarly get automatically extended, although through a
different mechanism in the law.
