H1B Fees Tax Deductible?
Hi,
I'm on an F-1 visa in my practicle training year. I'm working on a contract
basis though. My employer has offered to sponsor me for an H1B visa but the
costs are on me. My question is are the lawyer and processing fees for
getting an H1B visa tax deductible?
Thanks,
Sarah

No, legal fees are generally not tax deductable unless they are directly
connected to you earning money. Immigration matters are not directly
enough tied to your job, even if it's employment-based immigration.
If you can, negotiate to take a lower salary in return for the employer
paying the fees (just be sure the salary is still high enough to meet the
DOL prevailing wage).

Also be aware that the law requires the employer to pay some
parts of the filing fees (though not the lawyer costs).

The employer must pay the visa fees. Otherwise, they are doing
something illegal.
