Default H1B extention, when to apply?

H1B Visa itself expires in June 2006, but I-94 is until march 2007. When
should I get a lawer to apply for extention? Can I travel overseas and come
back between this two dates?Thanks.

Before your I-94 expires.

Yes, as long as you get a new visa before returning to the USA.

You may travel only to contiguous countries (i.e., Canada or Mexico) after your visa expires. And you must return to the U.S. within thirty days of departure from your trip.

Your visa will be extended at a port of entry for purposes of admission provided: you possess a vaild I-94; your trip did not exceed 30 days; your trip was only to Canada or Mexico; you possess a vaild passport; and you did not apply for a new visa during your trip.

without leaving US?

Not any more. Now you have to renew your visa outside the US. I believe
this can be done in a US consulate in Canada.

Does it mean that I can leave now and return on my current visa before it
expires in June 2006? Or I have to renew it there anyway to be able to come
back?

You may apply to extend your H1b visa with CIS 6 months before the
expiration of your I-94. Prior to this time, your case will not be
accepted.

In order to get a new travel visa in your passport, you must apply in
your home country or at a post in Canada or Mexico that processes visas
for third country nationals (ie, non-Canadians). Please be aware,
however, that if you decide to process your travel visa in Canada or
Mexico, then if your application is denied, you will not be permitted
back into the US...you will have to travel immediatley to your home
country to apply. This is a risk that many are not aware of.
