H1B extention

Default H1B extention

hi there,

my h1b visa/I94 both expires on march 2004 with that i'd be completing
5yrs. Anyways, i've plans to visit my home country for a short vacation
in december 2003. will there be any issues at the port of authority
while coming back they same month, since i'll left with only 3 months to
stay. however, my employer will file for an 1yr extn. in january though.

Any advice is muchly appreciated.

one more question, do anyone know the timeline for getting an h1b
extention in california or websites would help too.

That shouldn't have any problem with your entry back to US but make sure
that you have original I-797 & company ID, & all original doc. with you when
you come back to united states. I had the same situation & they asked for me
for both.

thanks dave. I thought one should have at least 6mths of valid visa
prior to entering united states. not sure from where i got that 6mnths.

thanks dave. I thought one should have at least 6mths of valid visa

as long as you have the visa stamped in your passport, you'll have no
problems getting back in, have your original approaval notice and a
letter from your employee confirming your status

you'll need to file for an extension with the INS at Laguna Niguel,
provided you file for the extesnion you'll be in status..

at the moment it's taking them about 2 months to approve extensions
for H-1b's

What? http://www.shusterman.com/pdf/csc.pdf says it's taking over 7 months,
and that matches with cases I know about.
