Hi,

My H1B (6 years) expired on 15th Sept 2001. My extension was filed on 13th July 2001. The INS asked for further information in early Nov. It was sent and when I contacted the INS (Nebraska centre), they said that they have received the info and it would take them another 120 days to process the extension.

Meanwhile I filed my 1-485 in November 2001. Will the delay in the H1B extension have any impact on the processing of the 1-485 particularly the EAD and Advance Parole?

I am automatically in the 240 day extension (H1 B) period. If the extension is not approved by May 2002 ( when the 240 day period ends), will I have to leave the US? If the EAD and AP comes through in the meanwhile, can I stay on based on the EAD and AP without the extension approval?

Any help will be appreciated.

Thanks,
Nan
