Default H1B to E2 dependent

Hi All,

My spouse is in the process of filing of their E2 visa along with my E2 dependent visa. I am currently employed on H1B which runs out in a few months time. Would like to know if I can continue my employment through this filing and subsequent EAD process that will follow? Any input will be really appreciated.

If you do not receive your EAD before your H1B expires, then no. Your E2 dependant visa is not valid for work without the EAD.

EAD's from date of filing can take anywhere from 4 months to 6 months these days.

There has been a distinct improvement in this lead time over the last year though. Most of the expat groups I'm involved with show around 90 days at the moment.

Saw someone post recently who got one at 134 days, others complaining they had been waiting 6 months plus, the 134 days thought they were lucky.

Seems all over the place.

Now these were family based.
