Question H1 for a charity?

Hello

I hope someone can help. I posted a similar question before but now the case is slightly different. My boyfriend has been helping out a charity in the US. He works in IT and has basically helped with the website etc remotely. He does this for free. The head of the charity has recently received quite a bit of funding for this website (it seems the website has taken off) and he wants to give some money to my boyfriend. We have been looking to move to the states for some time and we are wondering if this could work for him to get a visa to the states… Any ideas of what can be done. I have researched this for so long and personally I don’t think it will work (he has 10 years experience in IT, IT qualifications and a degree in the same subject area as the charity (not IT)) but I don’t know. The previous post dealt with me getting a an H1 visa and him coming on an H4 and still helping out with the website but I know now that is a no go. Please any idea is welcome!

H1 may be possible but the job would need to include a requirement for his degree skills as well as his IT skills.

www.kkeane.com has lots of good info on H.

I sem to remember offhand that you need 12 years experiance to substitute for the degree.

But you would have to wait for a year for the next batch of H's.

H4 would not seem approriate for his unpaid work.

yup, without any years to substitute it....and yeah, quota, shame that the charity isn't attached to a uni....but this will cost the charity a fair bit, which they could probably spend the money elsewhere.

Thanks for your help. The charity is attached to a University, the "owner" is a PHD professor of the university, I am not sure if that makes a different. We would not want to inconvenience a charity that much, so I would be prepared to pay for any costs associated with this H1.

You can not pay all the costs.

It is either a Uni function, or not.

But the Charity Lawyers would be the ones to advise, they will be processing the paperwork

It can't be attached to a person, it has to be part of the university to avoid the quota.

They also have to pay the costs as Boiler mentioned.
