H1-B Transfer question relating to vacation

Default H1-B Transfer question relating to vacation

Hi,

I handed my notice on to my current employer, and g ave them to the end of the year, 31 December 2010.
I have over 10 days vacation accrued for the year.
If I already have vacation booked, and it's owed to me, can I still take the vacation and be in status, as effectively I'm still salaried until the end of the year ?

That would depend on how it is dealt with.

If your contract finishes and they pay you in lieu of vacation then no.

Usually you have other benefits, health insurance etc, when do they cease?

Could you explain that ?

I am salaried, and receive the same amount every month.

If I have accrued vacation until the end of the year, and they don't pay me for it, then I am allowed to take is as vacation , correct ?

Some people prefer to physically take their vacation days before leaving the company. Some people prefer to continue working and then get the vacation pay included in their last paycheck.

As far as I know, that's correct, but you have to take the vacation days before your final official day of employment with that company.

When I left my last job I had a few weeks holiday left over. I was given a cheque instead.

I think I'm just going to take the vacation owed to me, not have it paid.
