H1-B issued before start date; HELP!

Unhappy H1-B issued before start date; HELP!

The company lawyer filed a petition for my H1-B with a fake start date which was 2.5 months before the actual start date (I didn't know about this before I got the approved petition; this happened in January when the visas were almost over so he said he did it to be sure I would get one; in fact he was fired 2 months later because he messed up most of his cases).

Anyway, I have been working for 3 months now and I need to go home to get a visa stamp. My start date on the petition is February 1. I started on April 15 (before I got the H1 I was on F-1 visa optional practial training which would be good for another 3 months)

Does it mean I was out of status while not working? Is there a chance tat the Consulte wll not gie me a visa? What should I tell the consulte? I am really scared and I really need your help!

PS: I have to travel in 2 weeks; it's a very important family matter so I don't have the option of not going.
