H1 B DENIAL APPEAL
my appeal for an h1b denial has been pending for some months now. how long does it
usually take for a decision? what are my chances? is there anything i can do if the
decision goes against me? thanks

The appeal may take many months, a year, or more. It is impossible to suggest your
chances without knowing the details of the particular case; it depends on the reasons
for denial, and the counterarguments that the employer presented in the appeal. It
could be a 10% chance or a 90% chance, depending on the issue.
Your employer should probably file another H-1B petition, which corrects the defects
of the original petition, and file it with a premium processing fee. Then you can
leave the U.S., get an H-1B visa stamp, and re-enter the U.S. in H-1B status.
Have you asked the immigration attorney why a fresh, stand-alone H-1B petition has
not been filed already?
