H-1B getting married - to US Cit/n-out of status

Default H-1B getting married - to US Cit/n-out of status

I will appreciate any help regarding our situation:

We were talking for a while for getting married with my US Girlfriend. I working here
in US , I Had H-1B till End of November 2001 at Company "A". Company "A" was going
down - so I had to leave. End of January 2002 Company "B" applied for me for a new
H-1B. I start working right away after we submitted the 1-129. Unfortunately in the
end of March we received a letter for request of evidences: INS wanted evidence for
when did I left the Company "A". The bad thing is that there is a gap between the day
I left"A" and the day we submitted the application with "B" We will submitt what they
need. My question is : If the application get rejected , does that mean that all the
time after I left Company "A" will count as a out of status , or the pending
application is an good excuse? Should we wait with my fiance to see if the
application will go through or we should get married as soon as possibel , because
otherwise I maight be out of status and I would be forced to go back to my country
and start over again. Are there any penalties for somebody like me with a overstay (
or out of status? ) who is getting married to US citizen. We want to be together ,
and to do it in the most efficient and legal maner. Thank you in advance!
