H-1B extension after 6 years

I talked to my attorney today and I couldn't believe he told me I am not qualified for
H-1B extension beyond 6 years because my Labor Certificate was approved in 360 days, 5
days short of the requirement in the new H1-B law. I read a lot today on the Internet for
information in this area and got conflicting and confusing information, but I still doubt
the fact I am not qualified for an extension in my situation. Here is my case:

Labor certificate filed in Sep. 1996, approved in Sep, 1997 ( but 5 days short of 365
days) I140 filed in late 1997 , approved in March 1998 and then waiting for filing I 485 I
485 filed in April 1999 and pending since.

I thought the only requirement is 365 days have passed since filing Labor Certificate or
an immigrate visa. In my case I am way past the required number of days. I'd really like
to hear another opinion here. AM I QUALIFIED FOR AN H-1B EXTENSION ?
