Green Card process with DCF (New Delhi)
I have used DCF from New Delhi, India. Do I need to prepare of fill out a form to make sure that my spouse gets his green card at the port of entry? The reason I am asking this is because one of my friends were given a form to fill when they applied from New Delhi, but we weren't given that form. Do I need to send my husband an I-485 along with I-864 for his visa interview?
Thanks.
Thanks.

I also did DCF from New delhi, but I never got any form to fill out when we
got the visa.
At POE she was just fingerprinted. I asked the custom afficer if we have to
do any additional paper work, he said no.
She has authority to work and can travel outside the country. She will get
the Greencard. in 3 to 4 weeks.
She did get the Greencard in 3 weeks.
But if you are in doubt ask those embassy people or email them. You get
reply in 2 weeks when you email a question to New delhi embassy.
Good Luck

1. Were you resident or non-resident in India when you applied for the DCF? When did you apply? I am trying to get a sense of whether things have changed since July 1 2003.
2. When you filed your I-130, did you have to submit your I864, or is this done only at a later stage?
3. When you called Delhi to ask whether DCF was possible, what exactly did you ask? Did you use the term DCF or did you say something else?
Please, your advice is really needed.
Thanks,
Tanon

Hi,
I just called the Delhi consulate yesterday and they did say that DCF is still available in Delhi and you do not have to be a Resident.
I myself am debating whether to go with DCF at Delhi or apply for K-1 which takes longer. What do you guys thinK? Which is the better option??

Re: Green Card process with DCF (New Delhi)
Dear Tanon,
If your spouse is applying for a green card by virtue of being married
to you and you guys apply at the New Delhi Embassy, your spouse will
have to submit an I-134 (as opposed to the I-864) as an affidavit of
support. This will be done at the spouse's final interview and not
your initial joint interview at the INS/BCIS office at the embassy
(when u submit the I-130).
The main difference between the I-864 and I-134 is that for the I-134
you need the last 3 years of income tax returns. Also, before the
embassy sets an interview date for your spouse they might send your
spouse a letter saying they need the I-864, but they actually need the
I-134. This will probably be clarified in the letter they'll send
after they finalize an interview date.
My advice to you would be to make sure you have all 3 tax returns, if
you lost some of them contact the IRS for transripts or copies. If you
did not file returns for the first 2 years and have a good reason,
don't sweat, the interviewer will place the most emphasis on your
current income and income reported in the last tax year anyway.

DCF definitely
If I didn't already have a K-1 in process I'd have done it
From the day you get to Delhi (with I-130 in hand) to your fiancee's
interview at the relevant Indian consulate should be not more than
about 3 months.
For K-1, assuming the fastest US turnaround for the I-129F, you will
be looking at 5-6 months.
Good luck

Re: Green Card process with DCF (New Delhi)
Hi A. Chakra,
I thought that I-134 was for non-imigrant visa; I-864 is for immigrant visa. And that's why k-1 requires I-134 while spouse/k-3 requires I-864. I have even checked out the forms on INS website and looked like immigrant category uses I-864. I-864 also requires the income tax returns from previous 3 years. Am I misunderstanding something?
Thanks.

Re: Green Card process with DCF (New Delhi)
Hi Tanon,
Everything I am telling you here is the information from May and June.
We did not have to submit I-864 at the time of filing I-130; however, it is required when the Indian spouse appears for visa interview. When we emailed and called New Delhi, we asked them what was required for DCF from New Delhi and we also clarified that the US citizen is not the resident of India. We also have a friend who was going through the process when we got into it, so we pretty much followed their footsteps. And amazingly, a few things were different for us than for them. In our friend's case, they had filled out a form (revised in 1987) to ensure that the Indian citizen would get a green card upon arrival to US. We were not given that kind of form, so I asked that question on this forum. Another difference was that our friend had two step process. Their forms/papers were collected in the morning and then all the petitioners were asked to return in the afternoon for the interview. When we went to file the petition, we were done with everything in the morning in about 2 hours, so we were confused on that issue also, but we asked couple of other embassy employees on our way out of there.
Hope this helps.

Hi Pjt,
Ooopss!!!! You're right!!!! Sorry for the confusion...I just wanted to
make sure that you would be using the form with the 3 years tax
returns requirements rather than the one with only 1. I also filled
out an I-864 for my wife about 7 months ago which she presented at her
final interview.
Cheers

Re: Green Card process with DCF (New Delhi)
Thanks for your guys help. For those of you that did do DCF in New Delhi, can you post about your spouses interview at the Delhi consulate.
I have read posts here that the Bombay consulate is really bad and makes peoples lives hard for no apparent reason. Is Delhi consulate any better than them. Thanks a bunch

At POE she was just fingerprinted. I asked the custom afficer if we have to
