Default GC Application.

Hello Everyone:

I am over 21 and married. I am a canadian citizen. My mother is a US citizen.

Whats the procedure for her to file a petition for green for myself and my spouse and
how long would it take for me to obtain a green card?

Is your mother a US citizen by birth or did she become a naturalized citizen. If she
was born in the US, and lived there at least 5 years, 2 over the age of 14, then you
are already a US citizen. You would be able to petition for your own family to move
to the US. If she is a naturalized citizen, or does not meet the residency
requirements, then she can file an I-130 for you to the Service Center for her area
and you will have to wait for the 3rd family preference visa to become current - the
wait is currently 6 years http://travel.state.gov/visa_bulletin.html. You may also
have problems visiting the US while the petition is pending, because it shows you now

Marf,

given that your mother is a US citizen (and presumably was at the time you were
born), you are also a USC by birth. Therefore, all you need to do is to claim your
citizenship at the US consulate.

You can then sponsor your husband for a green card.

You may be a US citizen now. It depends on where you were born (if in the US then you
are already a citizen) and where your parents were born and how long they lived in
the US. See

It will be much faster for you to file for your spouse once you become (or find that
you are) a US citizen.
