As a parent, what is your status? Are you not applying for a visa also? How
about the other parent?
Children at that age are usually under a derivative status and are included
in the primary applicant's (or parent's) application.
Is there any special situation in this case why the child has to be the
primary applicant?

The instructions of Form DS-3032 (Choice of Agent and Address for Immigrant
Visa Applicants) specifically state: ONLY the applicant can sign this form.

The applicant is this case is my 1 year old son.
My son is unable to sign the form, so am wondering what to do?
I noticed by researching Google history that this same question has been
asked here twice in the last few years and no one has ever been able to
answer it. If there is an expert in this newsgroup who has the knowledge to
answer this very difficult question, it would be appreciated. Thanks.

Hi:

Easy -- the parent signs THEIR name and then put "(mother)" after the signature. Been there, done that.

Notionally speaking, I am of the opinion that kid can't sign until they reach at least age 16 -- but I have them sign above age 10 or so -- the Government doesn't seem to care and the kid feels important in signing something.

Thanks for responding. Keep in mind that this question (DS-3032
instructions stating that only the applicant must sign) has been asked by
others in this forum according to Google history and no one has ever
addressed the question directly or ever answered it in the past. This means
that this isn't an isolated case or a fluke.

No, I am a US citizen

His mother is also an immigrant visa applicant. I am his legal father
(married before his birth), but not his natural father. Therefore he cannot
claim US citizenship by virtue of Consular Report of Birth Abroad and cannot
get a US passport. Separate I-130 petitions had to be filed for both my
immigrant wife and my son in accordance with Sections (1) "& (2.A.1) of the
I-130 instructions.
Separate petitions would not have been required if he had qualifed under
A(3), A(4), A(5), B(2) or B(3)
He will become a US citizen only upon entry into the USA by virtue of the
Child Citizenship Act.

Not really, since a separate petition will always have to be filed for an
unmarried child of a US citizen under the age of 21 in cases where the child
is not entitled to a US passport.
The fact remains that he is an immigrant visa applicant......which leads
right back to my original question which is apparently a very difficult one:

Thank you for your response. I will have my wife sign for him.
Strange that NVC and Dept. of State don't address the problem of child
applicants specifically.
Here is their directive:

THE APPLICANT MUST SIGN THE DS 3032; NO ONE ELSE HAS THE LEGAL AUTHORITY TO
DO SO ON BEHALF OF THE APPLICANT. FILES WILL BE HELD AT NVC UNTIL THE DS
3032 IS RETURNED.

Of course this is unreasonable in the case of an infant. Thanks again and
take care.
