I would like to pose a question to the newsgroup, I am the foreign fiancee for now
residing in Australia..... my question is: My Fiancee the US Citizen has a bad credit
rating accumulated during the time of his marriage to his ex wife. Since the divorce
he has maintained a good credit rating but still the house the ex wife now lives in
is in danger of forclosure, with his name still on the contract can this affect our
application?? As part of settlement she was supposed to obtain refinancing and have
his name removed but she has not done this! Thankyou [email protected]

His credit rating will not be taken into account. He must of course meet 125% of the
poverty levels or have a co-sponsor who does.

As long as he is not using that house as assets on his affidavit, he should have no
problems. All INS cares about is that his income is sufficient, they do not check
credit rating that I know of.
