Hello Everybody,

Please, give me an opinion or an advice regarding my situation.

My name is Vit (20 y.o.), and I am from Kazakhstan (former USSR). Currently I am a
student in NCSU. In October 1999 my family participated in Green Card lottery.
Fortunately, my mom has been precelected. After collecting all necessary documents,
our immigration interview was scheduled on January 9, 2001 in Moscow.

By the time of the interview, all 3 of us (mom, dad and I) had ACTIVE US visas: mom
and dad had one-time B-1 visas, and I had a year-long F-1 multivisa. During the
interview the immigration officer looked at our visas and said that we cheated while
applying for those visas that we had. There was a question in the visa application,
something like "Did you ever apply for immigration to the US?" And we answered "no".
How can a lottery be considered as immigration? It's just a "chance-taking".

Anyway, that immigration officer canceled ALL of our visas and took our immigration
case for further processing for "10 working days". Today is April 9th, it's been 3
months since then, and we still cannot get the answer. I call the US Embassy in
Moscow every week, and they keep telling me to wait.

What, do you think, we should do?

The consular office was probably referring to question 26 from form OF-156. The
question reads:

"Have you or anyone acting for you ever indicated to a U.S. consular or
immigration employee a desire to immigrate to the U.S., or have you ever entered a
U.S. visa lottery?"

As you can see, the visa lottery is specifically mentioned. You should have read the
form before answering NO.
