Extension of H1B and Labor Certification Filed

Default Extension of H1B and Labor Certification Filed

Hi everybody,

I have heard that if Labor Certification is filed for someone
on H1B visa and 365 days has passed since filing and no decision
has been made on it, H1B visa can be extended even after 6 years.

1) Is that right?

2) If it's correct, which part of LC does it mean? State or
Federal?

3) In that case, for how many years can the H1B visa be extended
at most?

Yes.

State, the very first step.

There is no limit.

Hi,
In continuation to the question asked earlier by a poster, if those 365
days of labor filing are from the previous employer, then can H1B visa be
extended after 6 years?
Please advice.
