Employment and W-4

Default Employment and W-4

Kind of a brief question but need an urgent answer.
Currently in the us at the moment legal to work with my I-766 (employment card) and just about to start my first job.
I came over on a K-1 visa and have filed all the paperwork for my green card.

My question is am i supposed to put on this form that I am a dependant? (form I-864) or can i file with just me and my wife ignoring that part?

Also does my father in law that is sponsering me have to put me down as a dependant on his tax return even though i am about to start work?

So you have filed your complete AOS package then, including the I-864, right?

When you say "this form", are you referring to the W-4 in your subject line? If so, then no, you don't have to put any dependents on that form, you can put 0. Putting 0 will get more tax withheld from your paycheck. Or you can put 1. Or you can put 2. Each number makes a different amount of federal tax withheld. The I-864 has nothing to do with the W-4 at all.

No, your FIL does not claim you as a dependent on his tax return.

Yes ur correct about me sending the i-864 with the green card stuff should b due an interview in the next month or so.

If your spouse works also, the w-4 can get complicated. That is because the basis of the form is to allow your employee to withhold the correct amount of taxes based on your yearly salary.

Therefore if both of you work and both of you claimed married filing jointly, each employer does not know about the other spouses income and assume it is $0. Therefore each employer basis the withholdings on the full deduction for the employee and the lower marginal tax brackets that one would have when only one spouse had income.

Thank you michael however my wife is disabled so this doesnt apply to me. However useful for any others reading
