Hi all,

I am now on stage 2 of the overall GC process (PERM approved) so onto the I-140 and I-485

My lawyer said I am in the second employment-based preference class but I think its a msitake as I am in the US on an L1-A visa so qualify for the first preference class.

My questions:

1) Is what I said above true?
2) Is there any real benefit to being in the first preference class over the second? first class category seems to have much better final action dates.

It's not automatic that you'll be EB1 because you're on an L1-A visa.

Yep so wanted to find out whether its worth raising with my attorney or not ?

Why is that relevant. It is in your mind worth raising it with your attorney. You're in a situation where you are almost desperate for a green card and ultimately citizenship, so why not contact him directly and ask.

Because it might not be worth it so was trying to guage expert advise on here as to whether its worth asking about or not.
My attorney is very difficult so I want to only ask him questions that are absolutely needed

The October 2018 visa bulletin actually shows EB2 as current and EB1 isn't.

Jackpot. And THIS is why I was asking. I'm glad I did ask because if I went to the attorney asking to make me EB1 that would not be optimal.
