Hi

I am curious about this!!

Acc. to the 245(i) anyone who files a labor certification or a I-140
petition before the April '01 cut-off date is elegible for AOS anyway
(irrespective of whether the petitioning employer is in business or
not)... For additional details, you may refer to this link -

So, in a way doesn't it ensure that anyone who was present physically on
the date of enactment of of this law and meets the above criteria can
still file and get a AOS done even if they get laid-off or is unable to
find a similar type job (with salary) after completion of the 180 days
under AC21 rule ..

Lets get some good advice and a debate goin' on this
