Employment authorization card EAD
Hello every one, I hope some one will be able to shed some good lead into
my case. Every year I go down to the local INS office and apply for renewal
of my EAD and pay the fee and walk out the same day with a new card. This
year INS change their rule and they ask me to mail in my application and I
have to wait 90 days before they give me a new card. I have a big problem
with this since my employer refuse to allow me to work for them unless I
have a new card. My current EAD card is expired 04-23-2003. Could some one
know any way to help me speed up my renewal application or refer my to a
good Immigration Lawyer.
Thanks for your help

Re: Employment authorization card EAD
There is supposedly some law, can't remember the name of it right now, where
employer cannot terminate you due to INS backlog. I had the same problem.
INS/Homeland security is backloged about 5 mths right now. Sent in renewal
in Feb, for EAD that was to expire end of March. Took until last week to get
receipt notice. No card yet.
Forget the lawyers, all they do is take your money and give BAD advice.
Contact your local Congressmans office. They have liasions with INS and can
cut some of the red tape.
Good luck

Usually all a congressman's office does is ask for status. They will take
serious action only if the BCIS does something egregious. Congresspeople cannot
ramrod your application ahead of the line. Especially not if you don't follow
the rules. I believe the 90 day rule has been in force for a few years now.
Correct me if I am wrong, someone...

Re: Employment authorization card EAD
Walk in EAD was the policy of some district/local INS office. It was
not INS rule that you will get it right away. Still some BCIS issue
EAD right away, some does not. Actually, most of the BCIS announce "No
more Walk in EAD". Now, ask your employer to keep your job and wait
three months for EAD. I dont see that congresspeople could help this
regarding this matter. Almost all the lawyer hasve informed their
clients to file application for EAD/AP at least 4 months before your
present one expire. Lot of attorney put this message at their web
site.
Sorry, that you did not stay tuned with those messages.

I don't think there is such a law. They can yank the petition any time they
want...
