Employment after the expiration of EAD
A friend of mine is working even after the expiration of EAD.
Q: What is the likelihood of him being caught?
He is going out of US for some reasons for a brief period during Christmas. He will have to come back to complete his education. He is in F1 status. He is worried if he cannot get visa from the consular for the reason that he is working after the expiration of EAD.
Q: Should he need to be too worried?

You're not very clear...are you talking about the OPT EAD? What education
program is he in--Bachelor's? If he has used up his EAD before graduating, he
will not be able to get another EAD after. He will have to get on an H-1 by the
time he graduates (or reasonably close to) if he wishes to stay in the US...
The likelihood that he will be "caught" by INS is remote, unless someone
reports him. However, in the event he DOES get caught, it will be hasta la
vista, baby (as Arnie would say)...

You're not very clear...are you talking about the OPT EAD? What education

Not really. The employer is the one who will get the penalties; he
will just lose his job with this employer. The only impact this will
have on him is invalidation of his nonimmigrant visa (if any) and an
inability to apply for adjustment of status on an employer-sponsored
basis. Marriage-based immigration (to U.S. citizen) will be
unaffected.
