Default EB-2 Permanent Resident

Hi All,

My employer is currently in the process of sponsoring me for permanent resident status - under the EB-2 category. I am currently on a H1-B visa (expires in September 2015). My extensions for the H1-B is also underway.

Wondering if anyone can shed any light on how long ETA9089's are taking for processing. My attorney filed on 2/10 and said approximately 5.5 months. Just checking to see what anyone else is experiencing?

That doesn't sound unreasonable for a PERM but your lawyer will know better. Some will be quicker, some will be slower. The main thing that could hold you up at this stage would be an audit.

Depends where you filed. Depends if they decide to do an RFE. I am assuming PERM etc is complete and the I-140 & I-485 have just been filed. Our I-140/I-485/AP/EAD were filed at Texas Service Centre on 5/9/14 and we got approval of I-140 & I-485 on 1/15/15. (We got an RFE on the I-140 11/25/14 and responded 1/8/15)

Here is our time line.
01/02/13 PERM Process Started.
03/18/13 PWD (Prevailing Wage) Filed.
05/01/13 PWD Issued.
06/19/13 Recruitment Process Started.
09/11/13 PERM Filed.
04/10/14 PERM Approved.
04/28/14 Medical at Civil Surgeon office.
05/09/14 I-140/I-485/AP/EAD filed. (Texas Service Center)
06/06/14 I-140/I-485/AP/EAD Receipt Notices received.
06/27/14 Biometrics.
08/08/14 AP/EAD applications approved.
11/25/14 I-140 RFE Issued.
01/08/15 I-140 RFE Reply filed.
01/15/15 I-140 & I-485 Approved!

Pedantic Stuart notes: the labor certification procedure is actually independent of the "EB" classification. That said, it is often crafted looking forward to the subsequent I-140 petition.

Thank you, everyone. This is really useful information. My employer has filed my PERM category under the EB-2 category. So once approved, my visa category is current. The PERM was filed on 2/10, so I assume I have a few months left to wait.
