EB-1 approved! When can I travel?

Default EB-1 approved! When can I travel?

Hi all

My EB-1 application was approved on 23rd March 2016. On 15th April 2016 USCIS received my medical documents, filing fee, I-140 etc. I am changing my status from O-1 to EB-1 and as such my priority date is current.

My question is - how long before I receive my documents? Has anyone been through this process?

I am currently landlocked and my grandmother is sick. I'm keen to be able to travel back to the UK if I need to.

You are free to leave the US at any time. Is there an issue that prevents you from travelling?

I understood that if I left the US during my change of status I'd be abandoning my Green Card application and it would be cancelled. Am I wrong?

I'm pretty sure that if you haven't yet filed an I-485, then you haven't yet actually applied for a green card. This other stuff is all just preliminary.

I'm sure someone will happily correct me if I'm wrong.

Ah right, it is me who is confusing things. I have filed my I-485.

Ah... well then, if you didn't apply for Advance Parole (form I-131) then if you leave the US before the I-485 is adjudicated, your application will be deemed abandoned. If you applied for A/P, then that and your passport are all you need to travel. In fact, if you didn't apply when you submitted the I-485, you can do so now. It'll take about 2-3 months for it to process, but once you have it you can travel outside the US without issue.
