early application with decree nisi

Has anyone out there started the K-1 process with only a decree nisi...we have been
told its possible to get the ball rolling as long as you send a covering letter...and
that you have a full decree absloute by the time of the interview...we would welcome
feedback from anyone who has already been through this.

You can not "file" the I-129F petition until you are both free and clear to marry.
You can start the paperwork if you want to BUT if you file before you are legally
able to marry it will be denied. Cover letter or no cover letter. You must be free
and clear to marry BEFORE you file the paperwork. There is no way around this.

That is the first I have heard of this happening. It has always been that a nisi is
not acceptable because the divorce is not valid for another 30 days. During those 30
days your spouse could decide not to finalize the divorce and you are up shit's creek
with a teaspoon for a paddle. If it were me, and it was by the way, I would wait the
30 days for the absolute decree and not waste time on RFE's

Hi Jan

I don't know if this helps, but I submitted our I-129F paperwork without the decree
absolute with a letter stating that the decree absolute would be sent to them as soon
as my fiancee got it and sent it to me. Apparently they didn't have a problem with it
and the ball did get rolling without it (we figured we could at least be entered into
their computer). Hope that helps a bit!

Then you are one in a million who got a worker who did not have a problem with
bypassing the regulations. Count your blessings.

Advised Jan to wait for the Absolute decree and will stand by that advice.

We were told that INS won't even look at the petition without the decree absolute.
Why not wait the extra 30 days for the absolute rather than the undetermined time for
INS to send out an RFE? H

I think that person said they send off the petition with the decree nisi, but they
did not say if it was ever approved. They very well could have gotten the 1st NOA but
all that means is that they have started processing the petition.

What I want to know is if it was approved without a RFE.
