EAD Stamp

Just wondering my fiance has bought a flight into Detroit and the POE rolling list
shows they have not been issuing the EAD card or stamp for quite awhile. What exactly
do we need to do if we do not get this at the POE? What forms? If he flies into
Seattle after the POE can we get it there? How long is the process if you do not get
it at the airport immigration? is it worth changing the ticket? Thanks, Megan

If you will be using Seattle office, you can see the times of others at this office
here: http://www.kamya.com/aos/washington.html#seattle
It might be possible to get a temporary EAD at the Seattle office, *however* bear in
mind, the INS business liaison just informed me that your K-1 fiance CAN WORK as long
as he gets a SS number and has the unexpired K-1 visa in his passport. They
stipulated that he does not have to have an EAD to work in the first 90 days. You can
find this referenced on the Doc Steen site in the "notes" link and in the AOS pages
both. (a copy of the e-mail they sent me is on those pages)

Wow thanks Alvena. My fiance flew into Raliegh Durham (NC) in August, asked for a
stamp and got it. Of course the INS fellas there werent all that sure what it was but
they gave it to him anyway. He now has a SS number that says he is authorized to work
with INS permission, or something like that.
What we are most concerned with is getting him EAD after the 90 days is up -- and
whether the INS offices will be able to get him a card in a timely matter, especially
with all that is going on. We are getting married this Thursday (yeah!) and will have
AOS in the mail by Friday.

As long as you have applied for the one-year EAD, the onus is basically on the
employer, and his status is officially k-1 until you receive that EAD card. As long
as the employer does not balk, I'd keep on working and hope for the best. You could
see if they would accept a filing receipt if they question it, but basically I
recommend a "if not asked, don't tell" policy at this point in time.
