Default EAD Expiry Date

I have just sent off the forms to renew my EAD along with the $340

My visa runs out in October 2010, do's anyone know if they will give me a 2 year EAD again, or will it run out in October along with my visa?

When does your husband's L-1 expire and is the company renewing for him? I'm afraid you're tied to his status.

This question looks the same as yours and was answered by an immigration attorney, FWIW.

It seems correct to me that your EAD can only be valid for as long as your status.

Yes we are here on hubby's L1, the company are slowly starting GC application, if this isn't done they will renew the L's...

Thats annoying that I will then have to renew and pay again in October for a new work permit

Wait, don't get too annoyed yet!

"start the GC application" is vague, but when you submit form I-485, you can apply for a new EAD as part of that status.. get this .... for FREE!
Ask the lawyers about that, so that you can maintain your employment authorization and have the timing all worked out.

Be sure to ask them about the ramifications of YOU working on an EAD that is based on the I-485. You will need to have a separate travel document (Advance Parole). As will your DH, if there is no underlying L-1 (you two are safer with both status' btw.. it never hurts to run the plan past your *own* immigration attorney. The company guy isn't working for you, KWIM).

Thanks for this, I know i'm a bit vague but thats how I feel. I hate not being in control of these things, its all through HR and Legal at my hubbys work, and like you say they are only interested in him, not me

About vague; I meant that people (and organizations) mean a lot of different things by "the green card process". Since specific forms and timing will be important for you, just ask the lawyers for the details about what will be filed when and under which category. That will allow you to do your own independent research.

And I didn't mean you alone by 'you'.. you & hubby might want to have your own advocate look things over.. his company isn't looking out for either of you first & foremost.

I didn't mean it all to be grim.. was hoping to help you get some specifics so you can feel more in control.

We actually need to be able to speak to a lawyer 1st. Once it actually gets to them from the expat division, it all seems to go through in a blur, or it certainly did with the initial visas. They are like some secret department in the organization that work under stealth mode
