Thats OK then - I think I am moving onto a 5 year E2 this time - but everything is in place through work as I understand it. Hopefully getting the interview wont be too bad

What visa are you on now then? Are you employed with a large company? My husband's American firm was bought by a large British firm and they shipped loads of workers over on the E2 treaty trader.

L1 - yes a large company with large quota of E2 visas - the only reason I got an L1 when first coming over was that the guy in the US Embassy who processed E2 has retired and not been replaced so they werent processing any for a while and they needed me here toot sweet!

Apart from the GC option are there any other implications of being on an E Visa? My wife will be able to renew her EAD so I dont see any other issues - or am I missing something?

The main probs are no GC, so have to leave eventually, and kids have to leave at 21 or find their own visa.
E2 spouses are also allowed to work, which is more than can be said for H4's.

period of admission is only good for 1 year max at a time. To extend your
time of authorized stay you must file Form I-539 with all the supporting
evidence that your business is still viable.

I dont think that is correct - you can stay for 12 AFTER your visa expires - the I-94 you get on entry isn't limited to 12 months from time of entry - that is the experience of colleagues and my legal advice

Correction: I meant to say: "...only good for 2 years max at a time."
You use Form I-129 and Supplement E to request extensions of stay but they
may be granted not more than 2 years at a time.

Maybe that the I-94 is for 2 years? - but this can go beyond your visa date - i.e. if I entered the country today - my I-94 would be good for 2 years even if my visa expires next month (obviously limiting travel o/s USA!)

No-one is doing anyting outside the law as it is immigration that stamps the I-94?
