Duration of stay question
Hello all
I have recently re-entered the US on my work visa (L1A) and thought the visa
expries in about a year, I was given an I-94 valid for 3 years. Which
document , visa or I-94, should I consider for the legal ammount of time I
can stay in the US withouth violating my status?

The visa is not relevant at all. The relevant
documents are your petition approval notice
and the I-94. If the I-94 is dated later than
the petition, then a mistake was made. I'm not
sure if you would technically be in status
after the petition date but before the I-94
date. Either way, I wouldn't risk it - it will
cause confusion and problems later.

The visa is not relevant at all. The relevant
documents are your petition approval notice
and the I-94. If the I-94 is dated later than
the petition, then a mistake was made. I'm not
sure if you would technically be in status
after the petition date but before the I-94
date. Either way, I wouldn't risk it - it will
cause confusion and problems later.

It's the date on the I-94 that counts. The visa stamp in your passport is
needed only when entering the US. Still, it's strange that your I-94 has a
date that's later than the one on your visa, unless you had your L-1A
extended and showed the extension approval (with a new I-94 tear-off) to the
immigration officer when

Thank you for your answer, but no, I did not have yet applied for an
extension.
I will however not take the chance, though it was not my mistake and I could
"claim" I regged myself my the I-94 date. But I prefer to do things right,
my BCIS experience so far has been nothing but positive so I don't want to
change that :-)

The thing is, even if BCIS makes a mistake, it is up to you to follow the
law. Their mistake does not give a person a free pass...technicalities and
fairness do not count-only the law.

Norammly the I-94 is given for the time remaining left on the visa
approval...It sounds like an error...you will need to renew the visa before
it expires or leave when the visa expires if it cannot be renewed

approval...It sounds like an error...you will need to renew the visa before
it expires or leave when the visa expires if it cannot be renewed
