I was given a police caution for urinating in the street after a night out. I was not arrested and after 6 months was called and given a police caution. No criminal record was given but my details are stored on the police computer encase u commit the same offense again i was told. Do i need a US visa as my interpretation is no as i was not arrested or convicted and don't have a criminal record. Even the Police website and home office state that a caution is not a criminal conviction or record. Any advise would be welcome.

My impression from discussions of cases similar to yours is that while this is probably treated as a conviction, it is most likely NOT a CIMT. So it should be ok to use the visa waiver program.

However, I am not an attorney.
