Default Dmv Suck !

Hi NG,

I went to take my written test to the Glendale DMV in the los angeles
area and was told by a supervisor that I could not be allowed to take
the test because of my pending I-751 status ! Ok here we go again, I
provided them with my expired green card (exp date 12/25/03 and two
I-751 receipt notices INS sent me extending my card to 12/25/04 and
the other receipt notice extending up to 02/19/05. They did not want
to hear it and the supervisor kept telling me that the receipt notice
was NOT sufficient and therefore that I was not elligible to take the
written DMV test. The problem is that now I do not have an I-551 stamp
in my passport and never thought I needed one unless I was travel out
the states. If I were to get an I-551 stamp how long will be issued
for and will INS issue me one now. I mean I still have until 12/25/04
at least that's what my first INS I-751 receipt notice says. So can I
still be issued a stamp now at this stage or am stuck and simply have
to wait for my case to be adjudicated and get a new 10 year green card
??

Each state DMV has different rules, so it is hard to say what they will and wont accept, but i have seen some posts saying they will accept an EAD. Do you have one of those?

I dont know if they will give u a stamp while you wait, but i would make some phone calls or an infopass appointment and find out. Possibly this also varies from office to office? I dont know, but it's worth a shot.

My EAD card and SSN was all they required here in the SF Bay Area, I am sure LA is the same. The EAD is actually listed on their website as evidence of residency.

Try going to a different DMV and see if you have better results.

She's a permanent resident already, she doesn't have an EAD.

Amel, go get the passport stamp and take that back to DMV.

LOL, I would have been on that as soon as possible, what would have happened if you had an emergency that you needed to leave the country (family death etc).
That stamp for me will be like gold dust

Because she doesn't need it for travel. For travel, her green card + the letter is sufficient.
that's probably why she's so cheezed with the DMV.

Here's what the California DMV will accept. I can see how the OP fell through the cracks.

Birth date verification and legal presence requirements

The issue of identification reliability, integrity, and confidentiality is of prime concern to all citizens. Eligibility for government services, issuance of various licenses, assessment of taxes, the right to vote, etc., are all determined through evaluations based on identification documents. It is critical that identification documents be authenticated and accurate in identifying each individual. The California driver license and ID card have been declared as primary identification documents in this state by the California legislature.

State law requires every applicant for an original California identification (ID) card and driver license to show verification of birth date and proof of legal presence within the United States to help safeguard the accuracy and integrity of departmental documents.

Only the original or a certified copy of one of the following documents is acceptable:

US Birth Certificate
US Certificate or Report of Birth Abroad
Federal Proof of Indian Blood Degree
INS American Indian Card
Birth Certificate or passport issued from a US Territory
US Passport
US Identification Card
US Military Identification Cards (Active or reserve duty, dependent, retired member, discharged from service, medical/religious personnel)
Common Access Card (only if designated as Active military or Active Reserve or Active Selected Reserve)
Certificate of Naturalization or Citizenship
Northern Mariana Card
INS US Citizen ID Card
Permanent Resident Card
Temporary Resident Identification Card
Canadian Passport/Birth Certificate
Non-resident Alien Canadian Border Crossing Card
Valid foreign passport with a valid Record of Arrival/Departure (form I-94)
Certification from California Department of Corrections or California Youth Authority
Employment Authorization Card
Permanent Resident Re-entry Permit
Refugee travel document
"Processed for I-551" stamped in a valid foreign passport
Valid I-94 stamped "Refugee," "Parole or Parolee," "Asylee," or Section 207, Section 208, Section 209, Section 212d(2), HP or PIP
Immigration judge's order granting asylum
Valid I-94 with attached photo stamped "Processed for I-551 temporary evidence of lawful admission for permanent residence"
Notice of Action (I-797 Approved Petition)
Mexican Border Crossing Card with valid I-94

Default Dmv Suck

Sorry but I tried posting in the new NG link given to me by Meauxna
and I was not able to which is why I am posting a brand new post her.

Thanks to all who replied, Marnee thank you as well. Meauxna is right,
I do not have an EAD. I am a permanent resident. My current green card
(conditional) has experied on 12/25/03 and the extension notice given
to the DMV was not sufficient. What worries me sick is that I have not
yet heard from the soto office as to wether or not my case has been
adjudicated. What is taking so long in the first place ? I sooo wish
to be called in with my husband for an interview, they could question
us separately as long as they desired because we are a real couple and
have a daughter together, we have nothing to hide. I just want to get
my 10 years green card.

The questions is this and I wonder if someone on this ng can provide
me with an answer, can I still get an I-551 stamp now or is it just to
late? In other words will INS issue me an I-551 stamp now up to
12/25/04 ??. My second question is if I wanted to travel outside of
the states now, will they issue me an I-551 stamp? And lastly what
should I do if INS does not approve my I-751 petition by 12/25/04 ?
Cleary, my card has expired, I have no I-551 stamp in my passport and
that receipt notice from my INS does not do me any good since DMV
thinks that I am no longer a permanent resident. I am soo frustrated
at this stage, I really should have gotten my I-551 stamp and now I
can't even get my driver's license.

Thanks to you all !

Hi:

I'm in LA -- you can get the stamp with no problem. Use InfoPass. Soto street has a backlog and they are working quite hard on it. But they do have a backlog.

Hi:

The superisor there is wrong. But don't fight city hall. Make an InfoPass appointment and you get a one-year I-551 stamp, no problem.

BTW, Pasadena is a lot nicer than Glendale DMV -- I speak from experience.

Yeah, but the OP has a I-551, so an EAD is not going to be relevant.
(Of course, a green card actually is an "employment authorization
document" :), but I assume you mean the "other" EAD )

Amel,

In order to post in BE, you need to register (pick a username and password). It's pretty seamless.

You have received good advice here.

I sense a bit of panic in your words.

Your I-551 status is automatically extended until you have your I-751 adjudicated. The date that the first NOA extended your I-551 card until is meaningless. The status is extended indefinitely until you have your I-751 adjudicated. So, 12/25/04 is not a drop-dead date by any means. Some would even argue it is a day to celebrate (ho, ho, ho). As others have said, make an Infopass and get your stamp. Most offices will issue you a stamp for a year (from the day you walk in).

However, for all practical purposes, you don't need the stamp unless you need to prove your status to a non-USCIS entity like DMV, an employer, or the airlines. In this case, DMV is all screwed up so you will have to get the stamp to make them happy. Otherwise, you wouldn't even need to get a stamp.

As a side note, I see that CSC is currently processing I-751s with a receipt date of May 19, 2004. Seing as how you submitted your I-751 in 2003 you might want to make an inquiry about the hold up. And, by the way, most people filing I-751s get approved without interview (so don't necessarily assume you will be interviewed).

Good luck.

Hi:

If I remember correctly, CSC is DONE with her case and has forwarded it to the Los Angeles District Office -- I-751's are now handled at the branch on Soto Street.
