Divorce AFTER Permanent GC and Citizenship...

Exclamation Divorce AFTER Permanent GC and Citizenship...

hi Everyone,

If someone has received their permanent green card, but is divorced about 8 months thereafter, I understand that this person will have to wait for 5 years to apply for citizenship (because no longer married to a US citizen).

However, will this divorce pose any problems in terms of actually getting citizenship? Will USCIS question the validity of the marriage if you are divorced after receiving your permanent green card and then apply for citizenship? I have moved on since the divorce and have not kept a lot of the documentation that proved our marriage. Will this be a problem?

No.

You'll be waiting 5 years from the time you became a PR, your citizenship won't be based on marriage, so your marriage is not even part of the factor anymore.

so does this mean that immigration will no longer look into the validity of the marriage to the us citizen? is this even if the permanent green card was received because of marriage to us citizen?

If you are filing the N-400 based on 5 years as a PR, then that's correct. You never know, the officer who interviews you *may* ask questions about your marriage, you just never know what they will ask, but in general your previous marriage should not be a factor in obtaining your citizenship once you have been a PR for 5 years.

thanks- so if I am divorced, then really it should not matter? does anyone have experience with this?
