Divoced, I-751 pending..

Default Divoced, I-751 pending..

Hi all. I have some question and wondering if anyone can give me some
advice. I was divoced and filed I-751 with a wavier by myself with a
lawyer's help. My ex-husband also agree to come to interview if I
want. (but he often promises me something and then forgot about it.)
We were in love for 3 years but only married for 1.5 years at that
time. I didn't have too much documents with both of our name on it,
but I did have a lot of pictures (vacation, graduation, ....) and
love letters since we were dating. Sould I be worry? Somehow I am
not worry about the interview, I married him because we were so in
love so I plan to tell the truth at the interview. And hopefully they
belive me. I am wondering how can the INS people judge couple and
their relationship by bank statement, legal papers...etc. My ex has
very bad credit history, and also a student, so except his part-time
company direct pay into my checking account and tax return. I have no
other legal paper to show them. We had our friends wrote us
supporting letters.
My company helped me filed I-140 before we were marry, and it was
approved right after the wedding. But we decide to go for marriage
based green card, thinking it might be faster....
If i can do everything all over again, I won't marry him out of love,
I will think more about money issue, culture issue and also make sure
he is a responsible person (he likes to lie).....and if i havent
marry him, my work based green card is on my hand already.
anyway....i have been waiting for this final interview for so long
that i did a lot of self thinking.......regreating what i did....if
INS deny me to teach me a lesson of love and life...then i learn
something Big time....
my life is on hold now. my current boyfriend want to marry me, but i
am afraid that it will affect my I-751 interview....my lawyers said
it might take a long time until i hear a date for interview. So
should I plan this wedding? or should I wait until I have an answer?
Do I need to let INS know when I marry? Can I say nothing about this
sencond marriage? I don't want to get my current boyfriend involved
with this....

Hi cat,
in my opinion you shouldn't worry - sounds like you have plenty of
evidence
on the bona fide marriage, also you had work based green card petition
approved.
And on the top of it all, you filed I-751 on your own, with the
waiver. So far you played
the game by the rules. A good lawyer would be helpful and you already
have one.
I think it's all a matter of time now and I wish you luck with a quick
responce from INS.
I read somewhere (it was a lawyer's comment) that it usually takes a
year to process a I-751 with a waver, and all that matter is to prove
you have been married out of love.
How does one prove that...I won't discusss...it's a word against
someone else's word.

One thing for sure though...don't lie to INS! Not saying is another
thing, but...for your own good, don't lie! As for your boyfriend, I am
sorry, but he would get involved at least to the point to know what is
going on, right?

There was someone in your same situation and her outcome was posted about a year ago. I believe it was in 2005. I don't recall her name but like you she married for love, received her CPR status, and then her and husband divorced. She file the I-751/waiver for removal of conditions but did not wait for a decision but instead remarried while the petition was pending.

Use the search engine of google for the alt.visa.us.marriage-based newsgroup and see if you can find her posts. There were several.

hi lliana, thank you for your advice. I haven't talk to any friend about
my worry. it's nice to just get my words out to share with someone.

If I were your lawyer and your facts are as you state them, I would not lose ANY sleep over this one.

Curiously enough, the strongest point in your case is that you had an approved I-140! You did not NEED to go via the marriage route! In the mid-90's I had a similar case -- with the exception that the client was also qualified under the "Chinese Student Protection Act" -- He went via the marriage as easier, quicker and the couple was in deeply in love. However, the wife was financially irresponsible and felt his job was to earn money for her to spend.

That waiver application [then on form I-752] has been the ONLY one I've ever had approved without an interview. In fact, we caught a brief period of rapid adjudication and it was FOUR days from mailing in the I-752 to receipt of the approval! INS proved my prediction of "two years and an interview" wrong. [And people wonder why I don't like to answer "how long?" ]

A remarriage would, IMHO, probably have no effect. I've done quite a few I-751 waivers in "the industry" and its been no problem. [However, CIS inspectors read "People" also.]

hi Folinskyinla, i thought of the same thing, like you said, I will tell
them that i had I-140 approved so i dont need the marriage based green
card in the first place. but somehow...as time goes by, the waiting game
is really tearing me apart. i am happy that i found this place to share
my thought.
it's been a long time waiting for this final interview, the lawyer i
worked with, has left the company 2 years ago, then 2nd lawyer they
assigned to me also just left last week. i am tire to find another
lawyer or company, it's gona cost me a lot. so i decide to stay put.
that's why i start to go online and see what others do for their case.
