Dilemma - Use approved CSC K-1 in Mumbai or do a DCF in Delhi/India

Default Dilemma - Use approved CSC K-1 in Mumbai or do a DCF in Delhi/India

I am so thrilled - got my NOA 2 for K-1 from CSC

NOA 1= Oct 24 2002
NOA 2= Dec 13 2002 (I 797 mailed out Dec 12 according to INS Website)


My fiancee's packet 3 requirements are already prepared in
anticipation.

My dilemma

1. Subject myself to the Potential "K-1 stress" in Mumbai ?
- She is 17 years younger, and I have been divorced twice ( I am
the USC).
- I have no kids and we are both of similar religious background


OR

2. Go to India in the next few weeks, get married and go to Delhi and
do a DCF with the I-130 ?
- Delhi INS/Embassy office repeatedly told me 'come on over
anytime'
- They faxed me detailed instructions how to do the DCF
- Her parents want a Hindu wedding

MY ASSUMPTION IS THAT IF I DO A DCF, I WILL PROBABLY BE DELAYED BY A
FEW WEEKS FOR MUMBAI TO OPEN A CASE (THE K-1 CAN BE OPENED IN MUMBAI
AS EARLY AS NEXT WEEK), BUT HOPEFULLY SHE WILL BE SUBJECT TO LESS
STRESS SINCE SHE WILL BE A WIFE, NOT "JUST" A FIANCEE DURING THE
ACTUAL MUMBAI INTERVIEW IN MARCH TIME FRAME.

Any comments appreciated....

May I ask why you would assume they would be easier on a spouse than a fiancee? If the case of MDMD101 is any indication, he was a divorced Indian USC who married in India and filed DCF in New Delhi. Mumbai still gave his wife a difficult time and their case is in Administrative Review.

Thanks for the insight Rita. I just had the impression talking to
Bombay consular person that they like to keep "families united"
implying that a I-130 approved from Delhi via DCF may be treated
'better' than a K-1 from CSC.

My lawyer says " the K1 approval is a bird in the hand", go with it,
and to strengthen your case, it helps for me to be in India and at the
consulate on the interview day...

This is a tough decision actually..but your insight is valuable.
