yes, got it. Are you presently in the US? If yes, how did you get in as you were twice returned? Sorry, perhaps I missed something.

You've engaged the services of a lawyer. Good luck, you will need it. Your case is piss poor, you don't need anyone on here to tell you otherwise.

FWIW, the MTR reflects precisely my reaction when I read the denial.

I don't know your case so I won't comment on the chances of success.

Until very recently the CIS has had the habit of deneying adjustments without a concomitant issuance of a Notice To Appear for removal proceedings before an Immigration Judge. I understand that CIS is reconsidering that practice.

If the MTR is denied, you might get lucky and placed in removal proceedings to get the ball rolling on litigation.

If CIS does not put you in removal proceedings, you might want to consider a declaratory relief action in district court. It won't be cheap. But it really pisses off this attorney on how the CIS violates the law on people like you.

rkeshwala if you just crossed over without inspection (as you mention) I would say you are wasting your time/money paying for legal work and the only way to do anything at all is to marry US citizen. I am not a lawyer, however, but I can't see a strong case here at all. In the same time, if you get out of the US you have no chance in getting in again, so I can see why you want to fight it from the inside.
