D156K and 9 month overstay
I am completeing my D156K form and I had a 9 month over stay in the US on an H1 from Oct 99 to June 2000 - I left voluntarily in JUne 2000 (INS never contacted me) and then came back later in 2000 to attend graduate school on a valid F1 (left in Aug 2003) after getting my degree.
I am filling out my D 156K and in one of the Yes/No questions
Will this overstay merits a "Yes" or "No" answer (over stay by 180 days and less than 1 year but left voluntarily in the last 3 years) - it is more than 3 years since I voluntarily left from the overstay (June 2000).
Will this mean that I have a greater probability of a refusal on my K1 visa?
Your thoughts and ideas are appreciated.
Thank you.
PS my H1 visa on my passport in 99 when i entered the country did have a D/S stamp - although I could not renew it since I had already used up my first H1 quota.
