Default COS L1 to H1

Hey Guys,

I have a quick question. My H1B COS has now been filed and I have the receipt. I know that these things typically take a couple of months but looking at trackit.com, some people are getting theirs approved in a few days.

If my H1B COS gets approved before October 1st, what status will I be in? H1B does not start until 1st October so will I still be in L1 and will I still be ok to work?

Excellent question! My gut reaction is that the employment authorization incident to status for the L-1 employer continues. Even if it does not, it strikes me that it would be a "no harm, no foul" type of situation.

I can't say that I have researched this and the above is what I describe -- a "gut reaction."

Note my caveat below.

Thanks S Folinsky. I'm not too concerned about it and i guess its going to take thenm a couple of months to process it anyway by which time H1 will be a valid status. Perhaps they can not even approve my H1 until then as they wouldnt be able to change my status to an invalid status...
