Default Consular advice on visa expiration

Wise advice sent to to immigration attorneys by Adrienne Taylor, Visa Chief, U.S. Embassy Paris: “We have seen many requests for interviews (from all visa classes) because people believe that once their visa expires that they need to exit the United States. Please advise your clients who are already in the United States that they remain in legal status in the United States even if their E-visa expires as long as they remain in status with DHS. This misunderstanding is creating unnecessary travel, and with the situation continuing to evolve we cannot guarantee that our ability to interview and the standards for granting a National Interest Exception (which are already very narrow) will not get more restrictive.”

Interesting comment about the NIE, was under the impression that had been pretty easy to get.

I’d imagine it varies from Embassy to Embassy.
