Default Is this considered working without and EAD?

I have a website that makes a bit of money - not very much!

If I received a check for this when I'm in the US on my K1 visa would this
be considered working even if I don't actually do anything on the website at
the time?

Should I change everything over so checks are payable to my fiance instead?

Thanks

Lindsey

No lawyer but isn't this residual income? If you where in a commercial and got paid every time it was shown it would be residual income - your not working for the money (you have already done the work) your getting residual payments for the work you did.

Personally I don't think that is a problem because your not working just getiing paid for work you did before. But surely getting the cheques paid to your fiance to avoid something could be construde as money laundering!

Excellent question -- the answer is not clear -- and since it is no immigration consequence, who cares?

Make sure to pay your taxes.

Somehow I don't think so but just to be on the safe side maybe have
the checks sent to your fiance.
Besides, what are the odds of the INS finding out about that anyways?

Peace
