clueless abt status of immigrant petition

Default clueless abt status of immigrant petition

My boyfriend was petitioned by his brother in 1990 for immigrant visa. A
lot of things have happened since then. My BF separated from his wife
(not legally though) and has been with me for 15 yrs now. The wife who
has all the petition papers refuses to to talk to him, doesnt give any
details about the petition-not even his case number. So my BF is
stuck!!!He's sure the petition is already approved considering the
lenght of time that has elapsed but he doenst know exactly how to follow
it up. He's in the Phils & has never traveled to the US yet. Would you
know how to help him?

Since you BF was petitioned under the 4th preference Family-based category
(brother of a USC), he has a long wait to go until the visa is available.
For Filipinos, it is now current only for those petitioned on or before
10/01/1983.

For a petition to be approved is not the same as having a visa available for
issuance!

Tell your BF to do more research and study about US immigration laws and
then have an immigration lawyer when it's really needed.
He might not even need a lawyer then once he learns more about what needs to
be learned.

sorry, he was actually petitioned in 1980, not 1990.

For tohers, it has already arrived. Mine was after 1990.

It was by his brother; why wouldn't it be approved. As for visa
availability, it deoends on her bf priority date on his case which
should be very close to the date his brother filed the petition.

Read family-based application at http://www.uscis.gov
See Visa Bulletin at http://travel.state.gov

Make sure he knows where to send applications, etc. If bf is outside
US, he needs his brother do soem things from US (this process is called
consular processing). If bf is inside US, he can amage to do it by just
getting necessary documents from brother. In this Adjustment of
process, make sure you ahve latest informaton where to mail application
package. Soem forms used are different for different process.

Bulletin?

Go to http://travel.state.gov
Look at visa area on th far right and click on more
On left, look for the link "Visa Bulletin".

If his brother knows the receipt number of the peititon filed for him,
they may be able to find out the PD by calling toll free number. Find
it by google.

Or, his brother can write to appropriate offcie.

Or get a lawyer for help. But he will charge for it.
