Clarification on AP
Hello all,
My fiance & I are nearing the submission of his K-1, but we have a question about the
AP. I have read so many things that I cannot keep it all straight.
After he arrives & we are married, we will file the AOS & for his EAD. He needs to be
over there for a family affair after Christmas. So...
Would you all recommend filing for an AP at the same time? or once we are married &
have filed his AOS, does this mean he doesn't need an AP any longer?
We have waited for so long to be together, we absolutely do NOT want to do anything
to jeopardize us finally being with each other.

First of all, please read this site http://www.k1faq.com/.
It will clarify the question you just asked, as well as many others.
You can't file for AP until you have filed for AOS.
When you file AOS, no this does NOT mean that he doesn't need AP any longer. If your
then husband leaves the country without AP his AOS application will be considered
abandoned (you will probably have to re-apply to the INS for a spousal visa to allow
him to come back to the US - this will take time). He will need AP to leave the
country (more specifically to return to the US) until he gets his green card (or
I-551 stamp).

File for the AP at the same time, without it he can't leave until the interview and
something about a stamp please correct me folks.
