Default Child Status Protection Act: Do I qualify?

Hi all,

I've been looking into the CSPA but because there are many provisions to the
law and its so new, Ive had a hard time figuring if I qualify or not. I was
hoping that by providing the details about my case, perhaps someone could
inform me whether I am eligible.

-Applied in July of 1995 for the I-130 (my mother sponsored me; she is a
permanent resident)

-Got a priority date of October 1995 (tho INS has it in their computer as
Oct.1996, still trying to fix that error with them)

-At the time of the priority date, October 1995, I was 19 years old (born in
June 1976)

-Turned 21 in June of 1997.

-I am about to turn 27 this June.

-My mother is a French citizen, and so am I.

We chose Consular Processing at the time, but from what I understand it
should not be a problem to change to AOS. I qualify for 245i.

Please let me know if, according to the info I've provided, I am eligible
for the CSPA.

The critical question is, how long did the I-130 take until it is
approved?

The CSPA would help you if it took at least six years to process.

By the way, why do you have a priority date in October if your case was
filed in July?

Thanks for responding Ingo. I know you're one of the most respected people
on this message group.

I may be wrong actually, I dont know why I said July. I think we did apply
around the fall, thats why the date is October.

I'm trying to understand this CSPA, tho its very complex. If I got a
priority date of October of 1995, and now we're in 2003, isnt that well over
6 years that I've been waiting? Right now, OCT 1994 is the current priority
date for my category (2B/ over 21), but March 1998 for the 2A/Under 21,
meaning that if I could be switched back to the 2A category via the CSPA,
my priority date would be current.

I'm trying to figure out what you mean when you say "How long did it take
until the I-130 is approved". I dont have anything that says "approval date"
all I have is the priority date, but I'm guessing it was "approved" at
around the same time in Oct. 1995, no?

One more thing Ingo.

If there is an approval date, how can I find out what it is? I'm looking
through all of the documentation that I have and all I see is the priority
date. If i call the NVC, might they have the approval date if i give them my
case number?

Unfortunately, the time spent waiting because of the priority date doesn't
count. Only the time spent waiting because of the processing time of the
petition counts.

Probably not. I would be very surprised if it had been approved before,
say, 1998. And if you are really lucky, it might still be pending and not
even have been approved yet.

The reason is that INS (and now recently BCIS, who replaced INS) is
horribly overloaded. So they de-prioritize cases that are not urgent.
Because the priority date is so far in the future, most family-based
applications fall into this group, and three to five or more years are the
rule rather than the exception. Normally, of course, such lengthy
processing times are not a good thing at all. But in this particular case,
it may actually work in your favor.

Depending on where you filed, it is entirely possible that you are indeed
lucky.

If the case is not yet approved, NVC won't even have it. Call the service
center where the I-130 is pending. My guess is that you may have to call
during the daytime, since such old cases may have been dropped from the
automated system.

I dont think its at the Service Center (TX) because I have documentation
from the NVC with a Case number, ect.., so they must have my case.

I tried calling them but no one was available to answer.

I'll try again and let you know as soon as I figure out what's going on.

Default FOUND THE DATE: Child Status Protection Act: Do I qualify?

Well, as usual, luck is not on my side. I was able to get through the NVC,
and the case was approved in August 2000

Do I have any other options, or do I simply have to wait until my priority
date becomes current (at the minimum, another year)?

Is it possible to attend grad school with a pending/approve I-130, if not,
is there anything I can do to get into some sort of "legal" status to attend
school while I'm going through this process?

Sorry for the many posts, but one more thing. Ingo, could you show me the
formula based on my information:

Priority date Oct. 23, 1995
Approved date Aug 7th, 2000
21th birthday June 1997

You take the approval date minus the priority date. In this case, that
would be around four years and ten months. Then add that to your birthday.
In this case, it would be April 2002. That is when you are legally
considered to be 21 (even though you really were 26 at the time!)

In that case, it is approved. The NVC only receives cases after approval.

In your case, of course, there is another option. Unless you are married,
you simply moved from the Family 2A category to Family 2B. So your
priority date will become current in a relatively reasonable time, maybe
two or three more years if you are lucky.
