I am on H1 and my wife is on H4 Visa (valid till May 2006) at the same
time she is doing masters (got admitted with scholarhip) she wants to
apply for change of status to F1 now so that she can work part
time/OPT.
We are planning to go to India this december(2005) and I heard that she
getting F1 stamped is very risky (Potential Immigrant).
So I was wondering
A) if she can come back on H4 status showing H4(still active) stamp on
her passport on port of entry and after coming here we will probably
apply for change of status to F1 again.
Or
B) Because she changed her status here to F1, she then needs F1 Visa or
NEW H4 Visa for change of status to H4 again.
