FWIW I googled "is fare evasion on transport a cimt" and one of the top answers was this page https://unlock.org.uk/advice/identif...urpitude-cimt/ which seems to indicate that fare evasion is a CIMT if prosecuted in court. Not advice at all but another pointer to consulting with an immigration attorney.

Then surely that answers your question - the 40 fares must have added up to more than £100?
Your current ESTA is invalid now, as you’re supposed to update it if any of the answers have changed. As said above, under the old question about CIMT’s you’d have had to answer yes, I can’t see why the new question would be any different. Theft does cause damage to somebody.
As for a lawyer, any on AILA would suffice. https://www.aila.org
Either speak to a lawyer and if they say you don’t need to declare it then get that advice in writing so that you have some comeback, or if you don’t want to consult a lawyer just say yes to that question if there’s any doubt. I certainly wouldn’t be ticking no without speaking to a lawyer first, the risk of a ban for misrepresentation is too high.

it added to £245 but I only got convicted for the time I got caught the £245 was just extra they wanted for it but my conviction it self is for the one time I was found

You cannot selectively exclude parts of your criminal past because you find it a pain. You KNOW what you did. Concealing it will not work out well for you if you’re discovered.

I know that my self it’s more I was telling the guy what the Unlock people said with the link they did same with the person who pulled up the picture of fare evasion and if it went court as it’s from the same website. I just don’t know if they go based of the single conviction or the multiple stuff cause on my record it’ll show as just one but I’ve ordered my police certificate and stuff just seeing what it says on there

Oh ok. What if someone has TFL bye law conviction and fine from court which has paid off already and knowing that this is non recordable. Already got ACRO report which says “No Trace†still needs to declare in Ds160
form?

For a H4 isn’t not going to cause you any issues, but you do need to be honest.

Thanks for your reply. I thought its just a fine and conviction means interaction with the police etc. So now what should I do? Our interview appointment is coming soon so what can I do now? Under new rules my ds160 form number and ds160 confirmation should be same.

I would email London and ask them to reopen your DS-160 so that you can amend it. If not, then just raise it at interview. As I said, I don't think it will be an issue at all, but not declaring it and being accused of misrepresentation could be.

Thank you for your response. I am thinking to take ACRO report with me and disclose it in front of visa officer. As in order to edit ds160 form again would be very time consuming and then will generate more questions.
