Default Can I get my Usa citizenship?

Hi Guy's,

How is it going?
I need to ask you something, because I have a big Problem.
My English is not that good. SORRY about that. I hope you guy's will understand me.

So, I am born in germany and I am from germany. I life already 8 months in USA. California. but, I would like to have a US Citizenship.
My mother is german and She lives in Germany and my father is US American and he lived his whole life in USA. So, I am half german and half american. I moved to USa because I want to study drafting and design.
Right now I have a big Problem. I won't get my US paper. That's mean I can't study. But I wantto do it.

My Story:

My father has a borther and they are twins. When they went to the USA Army, They sent both of them to Germany. Over there they met my mother. My mother got married with my uncle. But then my mother got in LOVE with my father. then my mother was in relationship with my father. Then I was born. After my birth my uncle signed the paternity. Then mu mother and uncle got separated. (DEWARS)

When I was 1 years old my uncle went back to USa. (Now I am 22 years old.) In USa my uncle droped of a house now He is in a wheelcair. After that my father went also back to USa, because he wanted to Help him.

Now I am in USa and usually I can get my paper, right? Because my father and uncle are American.
My Uncle wrote a letter to the government and he filled out all the papere from government. Then i got a letter back. In this letter war written that my uncle needed to live 5 years before I was born in german. But He didnt. Now my uncle is in a hospital and he might die. I am really scared because if he die i dont get my paper. We also tried to get my paper with my father but it doesnt work. Because my uncle is on my paper my father. I know its very confuse. I dont know what I can do. Do I have a chance to get my US Papre.

Would be great for some good infos. SORRY about my englihs its very bad. I need my papere. I like so much USa. I want to stay here. WHAT CAN I DO?

Read on Section 301(g) of the INA and also 7 FAM 1133.2-1, 1133.3-1c

Honorable Military Service, employment with US Government or international
organization, or as dependent unmarried son or daughter and member of
household of parent in such service or employment have certain exemptions
with regards to the residency requirements for transmitting citizenship.

Your situation needs to be studied in detail whether or not the reference I
mentioned would pertain to you.

I think the most important issue here is to find out if your legal father (your uncle) satisfies the residence requirement. Since you were born before November 1986, these are: 10 years physical presence in the US, 5 of which after the age of 14. Does your legal father meet this requirement? What about his brother?

Legally, who is your father? What does your birth certificate say?
was it your uncle or your father (biological father)? I think the
"LEGAL" father is the one that needs to petition on your behalf to
land you an immigrant visa (ie, Permanent Resident).

It is advisable to seek a reputable immigration to file the paper work
for u.

His legal father is his uncle, who was married to his mother when he was born. According to him the real biological father is the legal father's twin brother. I think he should first of all check if his legal father meets the physical presence requirements. If he does not, he may want to check whether his twin brother does (a bit difficult to prove paternity if they are identical twins, though). If all else fails, he could indeed get his legal father to petition for him as unmarried son/daughter (aged 21 or over) of a U.S. citizen. However I understand this can take years to process, and should be a last resort. Since his legal father is in poor health I would also recommend he should contact an immigration attorney ASAP.

After reading through message from OP the second time, I think you
conclusion is correct. And yes, a call to a lawyer is warranted.

Hi Guys

Thanks for all the infos....
I'm going to call the Lawyer and the german consulat in California.
I hope it will help me.

Yes my uncle is my legal father on my paper.
birth certificate say that my uncle is my father becasue he sign for me when i was born.
Mu biological father is my father and not my uncle.

Haja and my uncle is in wheelchair and his kidney is falid now he is in the hospital and might die. The doctor have to cut up his legs and arms. I think both of them need me. But right now my father is also in jail. Thats why i want to do it by myself. I think they are poor enough or?

I'm alone I have to do it by myself. I dont know what will happen.
My uncle filled out the intrie paper of immigration some infos he doesnt know any more.
I cant get HELP....

SORRY but i dont know what immigration attorney mean. Where can i find it? Im looking on internet :P

You are saying that your uncle did NOT live in the United States for 5 years
prior to your birth or else that your uncle did not live in the United
States for 2 years after he turned 14 years old?
