Can H1B Holder work from outside US ?
I am on a H1B visa now, but need to go back to my country for some
time. I have the following queries:
- Can I continue to be on the US company payroll and work remotely
(assuming of course that they are willing to this arrangement)?
- Is there any time-limit that I can be outside the US? I may have to
go for as long as a year.
- Assuming that I come back after more than a year, then does my H1-B 6
year validity period get reset?

Your H1B period is reset only if your company reapplies for your H1,
claiming you are a new appointment for a new job. Otherwise, the path you
should take should be an 'intra-company" transfer visa, L-1, which is
designed for this purpose- to move you in and out of different branches of a
multi national company. However, your company must be incorporated in the
country you will be living in (or you could be transferred to an office
outside the US just before you leave the US).
You have no problem being on the payroll and working remotely. For example,
a foreign investor could earn millions from the US in a year without setting
foot here. But, your H1 will lapse for long periods outside. It is
subjective. You do not need an H1 for what you want to do, of course. You
may need to pay taxes and other things in the US depending on the tax treaty
with your country and the particular way in which your company sets up
remittances to you.

One more question - when you say I don't need H1 for my purpose, what
does it mean from the companies standpoint? Under status do they hire
me on their payroll?
